I'm not no lawyer but I was wondering about this. Is it legal for IHC to be selling generic drugs? Shouldn't that be done with a different company out of the Bahamas? I know they said the pharmacyis based in the Bahamas. What's the company out of the Bahamas? Thesites are identical now http://www.myprivaterx.net and http://www.myprivaterx.com
Again, I'm not an expert on this stuff. Just wondering...

We do not own Fulfillment Centers, LTD. We have a marketing agreement with them, so we do "sell" the drugs we simply market them.
I do howver get to put my $.02 when advising on new drugs and always welcome feedback (HINT)!
As some of you already know the payouts for www.myprivaterx.net (http://www.myprivaterx.net) are insane!

Call any online pharmacy attorney in the state of FL (there are tons of'em!) and ask them if it is legal. I personally haven't done it, but it would be interesting to see what they say...

Dear Affiliates:
I would like to take this opportunity to clarify some of the issues regarding Fulfillment Centers Limited. I seek to distinguish this pharmacy from those that have been mentioned in the press recently. In those cases, generic medicines were substituted for brand name products and the patient misled or generic medicines were marketed as brand name products or customers received bogus medicine that simply did not work.
Fulfillment Centers Limited is a pharmacy located in Freeport, Grand Bahama. It is an entity that is licensed by the government and staffed by a licensed pharmacist. Nothing that it does is illegal or inappropriate in any way. This pharmacy dispenses generic pharmaceutical products in accords with all applicable law. The customer receives just what he/she requests: totally pure generic medications.
Impact Health Care has been placed under contract to help promote this entity here in the US and overseas as well. We plan to carry out our mission and will not be deterred by those that seek to hurt Fulfillment Centers Limited even though they have no vested interest in the company. In the coming weeks we are going to expand the formulary extensively. In the last 10 days our order volume has picked up markedly and I am happy that so many of you have come on board.
As an aside, the pharmacy is owned by one of the most distinguished attorneys in Freeport.
Sincerely,
Mark K Sachs, MD

I guess that attorney got tired of advising the OPs so he decided to go for his own OP. smileys/smiley4.gifJust like I got tired of designing sites for others at $200 or so per site at elance and decided to get rid of all the customers in one go.

I don't know... seems kind of risky. IHC is stillprocessing the orders. Is allorder processing and customer servicedone here in the states? Is that legal? Why not just start up another company and run it out of Freeport?Edited by: Affiliate

I'm not giving out legal advice here, but I noticed this in the following article:
http://www.miami.com/mld/miamiherald/business/6162243.htm
"Counterfeit drugs, which may be fake products or generic copies of real drugs made and sold without FDA supervision or approval, have long been a problem in other parts of the world."
It goes on to say:
"Viagra remains under patent protection, so any generic version automatically would be counterfeit under U.S. law and should not be allowed to be sold in this country."

Impact Health Care and theMr. Bennettbegan negotiations with Fulfillment CentersLTD 15 months ago to perform certain tasks.Mr. Bennettactually executed an agreement to help market this pharmacy. Now in a cynical act he seeks to defame and destroy that which he worked so hard on to create.
It was his decision to leave and he should do it with dignity.

Off Topic: It's so great we have an unmoderated forum to discuss all this stuff. We would be in the dark right now.

You are right, Ms. Hunt, but I'm not doing it now because it's illegal. Don't take my word or anyone elses, find out for yourself. Call a health care attorney in FL and you'll see.

Jason, If you really have doubts about the legality of what myprivaterx.net is selling then why were you involved in negotiations related to that or were you not aware at that time that it is illegal?
I have no vested interest in that site or its products cause I'm not promoting it. People here are selling Vicodin, Xanax and hydrocodone online. Why should I be worried about those affiliates and their merchants as long as I'm not selling that stuff? I think there are grown up people here, who are able to take care of themselves.

guys, if no one operated in the "grey area" of the law, affiliates wouldn't even be able to sell propecia without a prior prescription.
In a month, you may be thankful IHC is still around.

spdpharma,
Fulfillment Centers is the name of the pharmacy fulfilling the orders for www.myprivaterx.net (http://www.myprivaterx.net). They do not have a website.

Iggy,
So there is no confusion, IHC is not operating under any grey area. We have spoken with our pharmacies, doctors, and attorney. We do not believe we are inany danger. If you have any more questions I am in the office now and Dr. Sachs will be here later this afternoon, feel free to call.

It's all a grey area simply because the dea has stated it is illegal to sell prescription drugs based on an online consultation, no?
